These Terms of Service (“Terms”) govern your access to and use of the Marching Orders Direct website, online store, products, services, and related content (collectively, the “Site” or “Services”). By visiting our Site, creating an account, placing an order, or using our Services, you agree to these Terms.
If you do not agree with these Terms, please do not use the Site or purchase products from Marching Orders Direct.
1. About Marching Orders Direct
Marching Orders Direct provides products for purchase through our e-commerce website. Product categories may include, but are not limited to, items related to marching bands, performance groups, schools, organizations, uniforms, accessories, equipment, apparel, or related merchandise.
These Terms apply to all visitors, customers, account holders, and other users of the Site.
2. Eligibility
By using this Site, you represent that you are at least the age of majority in your state or jurisdiction, or that you are using the Site with the permission and supervision of a parent, guardian, school, organization, or authorized representative.
If you are placing an order on behalf of a school, organization, business, or other entity, you represent that you have authority to act on behalf of that entity.
3. Account Registration
Some features of the Site may require you to create an account. You agree to provide accurate, current, and complete information when creating an account or placing an order.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Marching Orders Direct is not responsible for losses resulting from unauthorized use of your account unless required by law.
4. Product Information and Availability
We make reasonable efforts to display accurate product descriptions, images, pricing, specifications, colors, sizes, availability, and related information. However, we do not guarantee that all information on the Site is complete, current, or error-free.
Product images are for illustrative purposes and may vary slightly from the actual product due to screen settings, manufacturing variations, supplier updates, or photography differences.
All products are subject to availability. We reserve the right to limit quantities, discontinue products, update product details, or refuse orders at our discretion.
5. Pricing and Payment
Prices are listed in U.S. dollars unless otherwise stated. Prices may change without notice.
Payment is due at the time an order is placed unless Marching Orders Direct has approved alternate payment terms in writing. We accept major credit cards, debit cards, and electronic payment methods including installment payment options where available through the Site.
You agree to provide accurate billing and payment information. By submitting payment information, you represent that you are authorized to use the selected payment method.
If a payment is declined, reversed, disputed, or otherwise not completed, we may cancel or delay your order.
6. Taxes
Applicable sales tax, use tax, or other government-imposed fees may be added to your order based on the shipping address, billing address, product type, or applicable law.
You are responsible for any taxes, duties, customs fees, or other charges associated with your order unless otherwise stated.
7. Order Acceptance
Placing an order does not guarantee acceptance. We reserve the right to accept, reject, cancel, or limit any order for any reason, including but not limited to product availability, pricing errors, suspected fraud, payment issues, shipping restrictions, or errors in product information.
If we cancel an order after payment has been processed, we will issue a refund for the canceled portion of the order using the original payment method when possible.
8. Custom, Personalized, or Special Orders
Some products may be customized, personalized, made-to-order, special ordered, or ordered in bulk for a specific customer, school, organization, or event. Custom, personalized, made-to-order, and special-order items may not be eligible for cancellation, return, exchange, or refund once production, ordering, printing, embroidery, decoration, personalization, or fulfillment has begun.
You are responsible for reviewing all proofs, names, numbers, logos, artwork, sizes, colors, quantities, and order details before approval. Once approved, changes may not be possible or may result in additional charges.
Orders placed through school-specific storefronts are subject to a published order deadline. Once the storefront closes at the published deadline, all orders are locked, batched, and submitted for fulfillment. Cancellations are not accepted after the storefront closing date under any circumstances, regardless of when the order was placed within the ordering window. By completing checkout, you acknowledge that your order will be held until the deadline and fulfilled as part of a batch shipment to the school facility.
9. Shipping and Delivery
All orders placed through Marching Orders Direct are fulfilled exclusively through a school-based batch delivery model. There is no individual home shipping. Orders are not shipped to personal addresses under any circumstances.
Orders placed through a school-specific storefront are held and batched until the published order deadline for that program. Once the deadline passes, all orders are submitted together and fulfilled as a single bulk shipment directed to the school facility designated by the program director. Delivery timing is subject to the batch fulfillment schedule and cannot be expedited for individual orders.
Marching Orders Direct will notify the program director when shipments are in transit and will provide tracking information where available. Due to the nature of multi-vendor bulk fulfillment, tracking may not be available for every shipment. Estimated delivery windows are estimates only and are not guaranteed.
Once a shipment is delivered to the school facility, responsibility for distribution to individual students passes to the school program. Marching Orders Direct is not responsible for delays, errors, or disputes arising from the school’s internal distribution process.
Marching Orders Direct is not responsible for delays caused by carriers, suppliers, weather, school or facility closures, natural disasters, labor disruptions, or other events outside our reasonable control.
10. Returns, Exchanges, and Refunds
All orders placed through Marching Orders Direct are considered final sale. Because products are custom, program-specific, and fulfilled through a batch ordering model on behalf of a school or organization, we do not accept returns or exchanges for any reason except manufacturer defects.
Sizing charts are provided within each storefront. Customers are responsible for verifying size selections before completing checkout. Incorrect size selections are not grounds for return, exchange, or refund.
If an item is found to have a manufacturer defect, structural damage, or manufacturing error, please contact us at info@marchingordersdirect.com within 7 days of the school distribution date with your order number, a description of the issue, and photos where applicable. Defective items will be replaced, corrected, or credited at no additional cost to the customer.
Refunds will only be issued in the following circumstances: a manufacturer defect cannot be resolved through replacement or correction, an item was not fulfilled due to a force majeure event as described in Section 23, or Marching Orders Direct cancels an order as described in Section 7.
11. Damaged, Defective, or Incorrect Items
Please inspect your order promptly upon receipt at the school distribution event. If you believe you have received a damaged, defective, or incorrect item, you must contact us at info@marchingordersdirect.com within 7 days of the school distribution date. Include your order number, a description of the issue, and photos where applicable.
Claims submitted after this window will not be eligible for review. Marching Orders Direct is not responsible for damage that occurs after items have been distributed to students.
Resolution options may include replacement, correction, or store credit at our discretion, depending on product availability and the nature of the issue. All resolutions are subject to the terms outlined in Section 10.
12. Cancellations and Changes
Order cancellation or change requests should be submitted as soon as possible. We will make reasonable efforts to accommodate changes, but we cannot guarantee that an order can be canceled or modified once processing has begun.
Custom, personalized, bulk, made-to-order, and special-order items may not be cancelable once work has started or materials have been ordered.
13. Promotional Codes and Discounts
Promotional codes, coupons, discounts, and special offers may be subject to additional terms, expiration dates, exclusions, minimum purchase requirements, or usage limits.
Promotions may not be combined unless expressly stated. We reserve the right to modify, suspend, or cancel promotions at any time.
14. User Content, Artwork, and Submitted Materials
If you upload, submit, email, or otherwise provide logos, artwork, designs, names, text, photos, files, or other materials (“Submitted Materials”), you represent and warrant that you have the legal right and permission to use those materials and to authorize Marching Orders Direct and its vendors or service providers to use them for the purpose of fulfilling your order.
You agree not to submit materials that infringe the rights of others, violate any law, contain offensive or harmful content, or misrepresent your authority.
Marching Orders Direct may refuse to produce or fulfill orders containing materials we believe may violate law, third-party rights, school or organization policies, or our business standards.
You retain ownership of your Submitted Materials. However, you grant Marching Orders Direct a limited license to use, reproduce, modify, transmit, and share those materials with vendors, suppliers, contractors, or service providers as needed to process, produce, and fulfill your order.
15. Intellectual Property
The Site and its content, including text, graphics, logos, images, designs, software, layout, branding, product presentation, and other materials, are owned by or licensed to Marching Orders Direct and are protected by copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, modify, display, sell, or exploit any part of the Site or its content without our prior written permission.
All third-party trademarks, logos, product names, school names, organization names, or brand references belong to their respective owners.
16. Acceptable Use
You agree not to use the Site to:
- Violate any law or regulation;
- Interfere with the operation or security of the Site;
- Attempt to gain unauthorized access to any account, system, or network;
- Submit false, misleading, or fraudulent information;
- Use automated tools to scrape, copy, or harvest Site content;
- Upload malicious code, viruses, or harmful files;
- Infringe the rights of Marching Orders Direct or any third party;
- Harass, abuse, threaten, or harm others; or
- Use the Site for any unlawful or unauthorized purpose.
We reserve the right to suspend or terminate access to the Site for violations of these Terms.

20. Disclaimer of Warranties

We do not guarantee that the Site will be uninterrupted, secure, error-free, or free of viruses or harmful components. Some products may be covered by manufacturer warranties. Any manufacturer warranty is provided by the manufacturer, not Marching Orders Direct, unless otherwise stated.
21. Limitation of Liability
To the fullest extent permitted by law, Marching Orders Direct and its owners, employees, contractors, suppliers, service providers, and affiliates shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, or reputational harm arising from or related to your use of the Site, purchase of products, or these Terms.
To the fullest extent permitted by law, our total liability for any claim related to an order shall not exceed the amount you paid for the product or service giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
22. Indemnification
You agree to indemnify, defend, and hold harmless Marching Orders Direct and its owners, employees, contractors, suppliers, service providers, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from or related to:
- Your use of the Site;
- Your violation of these Terms;
- Your violation of any law or third-party rights;
- Materials, artwork, logos, or content you submit; or
- Your purchase, resale, distribution, or use of products purchased through the Site.
23. Force Majeure
Marching Orders Direct shall not be responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, severe weather, war, terrorism, labor disputes, supply chain disruptions, carrier delays, power outages, cyberattacks, government actions, pandemics, or other events outside our control.
24. Governing Law
These Terms shall be governed by the laws of the State of Georgia, without regard to conflict of law principles.
Any legal action or proceeding related to these Terms, the Site, or purchases from Marching Orders Direct shall be brought in the state or federal courts located in Lowndes County, Georgia, unless otherwise required by law.
25. Dispute Resolution
Before filing a claim, you agree to contact Marching Orders Direct and attempt to resolve the dispute informally. We will make reasonable efforts to resolve customer concerns in good faith. Any dispute that cannot be resolved informally may be handled through the courts or other dispute resolution process available under applicable law.

27. Severability
